Mississippi regulators and SpaceX signed an agreed order covering the unpermitted turbines running Colossus. They come out over the next year, and a permanent 1.2-gigawatt plant replaces them.

The temporary gas turbines that have been powering xAI's Colossus cluster in Southaven, Mississippi without air permits are coming out. SpaceX and the Mississippi Department of Environmental Quality signed an agreed order on Friday covering all 69 of them.

The schedule

Removal begins in August 2026 and completes by July 2027. In the meantime the order imposes conditions: fortnightly shutdown reports, a retirement date for each turbine, emissions testing on the 14 cleanest units within 60 days, and continuous monitoring. The unpermitted units were estimated to emit more than 2,000 tons of nitrogen oxides a year.

This is the part the headlines invert. The temporary turbines are being replaced by a permanent 1.2-gigawatt plant of 41 turbines, each between 16.48 and 50 megawatts, permitted under the Clean Air Act in March 2026. Net gas-burning capacity on the site increases. The Southern Environmental Law Center also notes that nine turbines were added in July, while the removal was being negotiated.

What kind of document this is

An agreed order is a negotiated route back into compliance. It is not a penalty, no fine has been announced, and nothing was shut down. The 1.2 gigawatts is permitted nameplate capacity, which is what the plant is allowed to run at, not what it will generate.

Musk's announcement of a fourth site, with 220,000 GB300s, was posted on 29 July. It is a different event, and coverage fusing the two is producing a story about neither.

What the two years bought

The sequence is worth stating plainly, because it is the reason this case has been watched. Turbines went in without permits. They ran while the objections were litigated and lobbied. A permanent plant was permitted in March. And the settlement for the unpermitted period is an agreed removal schedule stretching to July 2027, with no fine attached. For anyone deciding how to power the next cluster, that is a costed answer to the question of what happens if you build first.

Why It Matters

The Southaven turbines became the test case for whether an AI company can build generation first and get permits later. The answer is that it can, for about two years, and the settlement leaves it with more permanent capacity than it started with.
